1. These terms
These Terms govern your use of Align360, including align360.io and the Align360 app (the "Service"). The Service is operated by Feeling Like Chocolate, LLC ("we", "us"). By creating an account, signing in or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. You must be 18 or older
The Service is only for people who are 18 or older. By creating an account or using the Service, you confirm that you are at least 18. If you use the Service on behalf of an organization, you also confirm that you have authority to accept these Terms for it.
We may close any account we believe belongs to someone under 18 and delete its data.
3. Your account
Give accurate information, keep your password private and tell us promptly if you think someone else has used your account. You are responsible for what happens under your account.
4. What Align360 is, and what it is not
Align360 is a personal and professional development tool. It uses assessments and AI to help you reflect on how you work, what you value and what to do next.
It is not medical, mental health, legal, financial, tax, investment or employment advice, and it does not replace a qualified professional. Assessment results, reports and AI responses can be wrong, incomplete or not right for your situation. Use your own judgment, and talk to a qualified professional before making decisions with health, legal, financial or safety consequences. We do not promise any outcome, including a job, income, promotion or performance result.
Align360 is not an emergency service. If you are in crisis or thinking about harming yourself, call or text 988 in the United States, or contact your local emergency number.
5. AI-generated content
Many responses and reports are generated by AI models. They may contain mistakes and may not reflect your circumstances. You are responsible for how you use them.
6. Your content
You own what you put into the Service: your answers, messages, documents and other content. You give us permission to store, process and display that content only as needed to run and improve the Service for you, including sending it to the service providers that host the Service and generate AI responses.
We do not sell your content and do not use it to train AI models. Only upload content you have the right to share, and do not upload other people's sensitive information without their permission.
7. Organizations and team accounts
If you set up an organization, you accept these Terms for it and you are responsible for its seats, its invitations and having a proper basis to invite people.
If you join through an organization, its administrators can see your name, email address and role, and team-level patterns once enough members have chosen to share. They cannot see your individual answers, reports or conversations through the Service. Your personal results stay in your account.
Do not use Align360 results as the sole basis for a hiring, firing, pay or promotion decision about another person.
8. Plans, billing and cancellation
Paid plans are billed in advance, monthly unless stated otherwise, through our payment processor, Stripe. They renew automatically until cancelled. You can cancel at any time by contacting us, and cancellation takes effect at the end of the period you have paid for.
Fees are non-refundable except where the law requires otherwise. Pilot and early-access prices may change; we will tell you before a new price applies to your next renewal. You are responsible for any applicable taxes. If a payment fails, we may suspend paid features until it is resolved.
9. Acceptable use
Do not:
- break the law or infringe anyone's rights while using the Service;
- try to access another person's account or data, or get around our security or usage limits;
- copy, scrape, resell or reverse engineer the Service, its assessments or its content;
- upload malicious code, or use the Service to harass, deceive or harm anyone.
We may suspend or close accounts that break these rules.
10. Our property
The Service, including its assessments, frameworks, reports, software, designs and brand, belongs to us or our licensors. We give you a limited, personal, non-transferable right to use it under these Terms, for yourself or for your organization's internal use.
11. Other services
Some features rely on other companies, such as Google for sign-in and Stripe for payments. Their own terms apply to your use of them, and we are not responsible for their services.
12. Changes to the Service
We are actively building the Service. Features, including early-access and pilot features, may change, be paused or be discontinued. You can stop using the Service at any time.
13. No warranties
The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement, and we do not promise that the Service will be uninterrupted or error-free.
14. Limits on our liability
To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from or related to the Service or these Terms. Our total liability for any claim is limited to the greater of the amount you paid us for the Service in the 12 months before the claim and US$100.
Some places do not allow these limits, so some of them may not apply to you.
15. Indemnity
You agree to defend and hold us harmless from claims, losses and costs arising from your content, your use of the Service or your breach of these Terms.
16. Governing law
These Terms are governed by the laws of Arizona, without regard to its conflict of law rules. Any dispute will be heard in the state or federal courts located in Arizona, and you and we consent to their jurisdiction.
17. Changes to these Terms
We may update these Terms. When we do, we will post the new version here with a new effective date, and for material changes we will give notice in the Service or by email. Continuing to use the Service after a change means you accept the updated Terms.
